1) What we do (Scope of Service)

We remove snow from residential driveways, walkways/sidewalks on your property, and (if selected) city windrows at the end of your driveway. Services may include ice control (salt/sand) if you add it. We do not perform roof, deck, or elevated surface clearing unless expressly stated in your plan.

• Seasonal Plan: Unlimited service during the winter season defined by our service calendar (e.g., Nov 1–Mar 31) when snowfall or drift meets the trigger below.

• Per-Visit: One-time service after your order is accepted and scheduled.

• Priority Route Add-On: Places your address earlier on our route after qualifying snow events; it is not a guarantee of a specific clock time.

2) When we come (Trigger & Timing)

• We dispatch when snowfall or drifting meets or exceeds your city’s typical trigger (commonly 2–5 cm) or when conditions create unsafe access, at our discretion.

• Start times depend on storm timing, accumulation, wind, temperature, traffic, and route logistics.

• Priority Route addresses are serviced before standard addresses on the same route, but no exact time is guaranteed. Severe weather, road closures, and municipal plowing may delay service.

3) Your responsibilities (Access & Site Conditions)

You agree to:

• Provide safe access: move vehicles, garbage/recycling bins, extension cords/hoses, and other obstacles before we arrive.

• Mark hazards: clearly mark sprinklers, pavers, low edging, raised concrete, decorative lighting, and other hidden hazards.

• Maintain surface condition: uneven, heaved, or cracked concrete/asphalt, loose pavers, and poorly bonded coatings are inherently vulnerable.

• Pets & gates: secure pets; ensure gates aren’t frozen/locked.

If areas are blocked or unsafe, we may skip that portion (no refund for that portion of the visit).

4) Ice & re-freeze (Important limitation)

Snow clearing does not eliminate all ice. Melt and re-freeze can occur after service due to sun, temperature swings, or continued precipitation. Unless you add Ice Control, you remain responsible for additional salting/sanding. Even with Ice Control, slippery conditions can still occur.

5) Windrows (Street plow berms)

If you add Windrow Clearing, we’ll open a path from your driveway to the roadway where practical and lawful. City plows may create new windrows after we leave; additional clearing may require another visit.

6) Property damage disclaimer

We take care, but we are not responsible for:

• Pre-existing or hidden defects (e.g., spalling, cracks, heaved slabs, loose pavers).

• Damage caused by unmarked hazards or buried objects.

• Scratches/gouges that are normal risk when metal/plastic edges contact rough or heaved surfaces.

• Damage resulting from frozen gates/locks/fences or brittle materials at low temperatures.

If we cause clear, avoidable damage to marked and sound areas, notify us within 48 hours with photos so we can review and make it right.

7) Weather & force majeure

We are not liable for delays or failure to perform due to events beyond our control, including severe or continuous snowfall, blizzards, extreme cold, freezing rain, road closures, power/internet outages, equipment failure despite reasonable maintenance, or government orders.

8) Scheduling, cancellations & refunds

• Seasonal Plan: prepaid; covers unlimited clears within the season. No proration or refunds after the season begins, except where required by law.

• Per-Visit: can be cancelled before dispatch for a full refund. If we arrive and cannot access, the visit is considered completed.

• Priority Route: fee is for route priority only; no specific time is guaranteed and fees are non-refundable once the storm dispatch begins.

9) Safety & bylaw compliance

We follow reasonable practices and applicable bylaws for pile placement and pedestrian safety. You remain responsible for your bylaw compliance (e.g., clearing public sidewalks within required timeframes) and any tickets/fines not caused by our delay.

10) Photos & quality control

You authorize us to take before/after photos of serviced areas for quality assurance and proof of service. We may use non-identifying photos for marketing unless you email us to opt out.

11) Payments & charges

You agree to pay the plan or per-visit price and any selected add-ons (Windrow, Ice Control, Priority Route). Unpaid balances may pause service. Returned or disputed payments may incur administrative fees.

12) Liability limitation

To the maximum extent permitted by Alberta law, our total liability for any claim related to the services is limited to the amount you paid for the specific visit (Per-Visit) or one month of fees (Seasonal Plan). We are not liable for consequential, incidental, or special damages (including slips/falls after service, re-freeze, or subsequent windrows).

13) Indemnity

You agree to indemnify and hold SnowHero harmless from claims arising out of unmarked hazards, unsafe site conditions, or your failure to follow these terms, except to the extent caused by our gross negligence or willful misconduct.

14) Term, termination & changes

• Seasonal Plan runs for the posted season dates. We may suspend or terminate for safety, non-payment, or repeated access issues.

• We may update these terms on our website. The most recent version applies to ongoing service.

15) Governing law

These terms are governed by the laws of Alberta, Canada. Venue for disputes is Edmonton, Alberta.

Customer Acknowledgment

By booking SnowHero you confirm:

1. You have read and agree to the SnowHero Liability Waiver & Service Terms.

2. You are authorized to order service at the Service Address.

3. You understand that ice can reform and that no exact service time is guaranteed, including with Priority Route.

4. You accept the limitations of liability and indemnity provisions.
